Children’s Privacy
People under 13 years of age are not permitted to use the Services for any purpose and TipStars does not collect information from or about anyone under the age of 13. Users are not permitted to use the Services to upload personal information about a child under 13 years of age. If we learn we have collected or received personal information from or about a person under 13, we will delete that information. The Information We Collect
Creating a Profile
If you register to use the Services and create a profile for yourself you may voluntarily give us certain information about yourself such as name, email address, name, phone number, birthday, postal address, photographs or other information. You may also provide additional information about your tastes and preferences so that we may recommend appropriate Content.
Artist Social Security Numbers
If you upload Art on TipStars you become an Artist. When you become an Artist we may need to collect your social security number. TipStars will use your social security number as necessary to file tax forms for qualifying income earned through the app. Please review TipStars’s Social Security Number Policy is located below for more information about how TipStars collects, protects, uses and discloses your social security number.
User Content
When you visit or use the Services you may voluntarily upload content that may include images, videos, sound recordings, comments, or other content. Please be aware that any content you upload to the Services will be viewable by other registered users of the Services and may be available to the public at large. Your content will be linked to your username, which will also be viewable by registered users or the general public. Please, only post content that you are comfortable sharing and that you have the full right and authority to post in accordance with these terms. We recommend you don’t share personal information or other information that can be used to identify or locate you.
Financial Information
TipStars uses Stripe, a secure payment provider, to process your payments if you leave a financial tip over the Services. Your payment information is subject to the privacy policy and terms of use of Stripe. We recommend you review these policies before uploading any credit card information. TipStars does not have access to your credit card information and does not store this information on our servers.
Inviting Friends
We may encourage you to invite your friends and family to join the Services and provide feedback and Tips on your Content. Please only invite third parties that have agreed to receive that type of communications with you. You may not send unsolicited or other emails that could be considered SPAM to third parties regarding the Services.
Visiting the Services
If you contact us or register to join a mailing list, you may voluntarily provide certain information that can be used to contact or identify you, such as your email address, name, phone number, postal address and other information related to your question or preferences. We collect this information for the purpose of providing the Services, identifying and communicating with you, responding to your requests/inquiries and improving the Services. You may opt out of receiving marketing communications from us by following the unsubscribe link or instructions provided in any email.
When using the Services you may choose to provide information on publicly accessible portions of the Services or share information with other registered users through private messages. Please be aware that any information you publicly post on the Services may be viewable by TipStars’ members or the general public. We recommend you use caution when publicly posting or sharing privately information on the Services and that you do not post personal information or other information you are not comfortable sharing with the general public.
If you’re using the Services on your mobile device, you may also choose to provide us with location data.
Access and Log Data
Like most website operators, TipStars collects non-personally-identifying information of the sort that web browsers, mobile applications and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request when visitors use the Services. TipStars purpose in collecting non-personally identifying information is to better understand how TipStars visitors use the Services. From time to time, TipStars may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Services. TipStars also collects potentially personally-identifying information like Internet Protocol (IP) addresses and may collect statistics about the behavior of visitors to the Services. For instance, TipStars may monitor the Services to help identify spam. Public Posting
You may choose to post a Talent or comment on a posted Talent. Please be aware that any information or images you post will be publically available. Please do not post any information that could be used to identify you or your location on the public portions of the Services.
Promoting Talent
We may wish to share your artistic contributions with talent agents, promoters, marketers or other third parties to promote your work or the Services. We have the full right and authority to share your Content, which may include images or videos of your face, voice or appearance with third parties without restriction. Except as otherwise provided in this Policy, we will only disclose your personal or contact information with third parties upon receiving your consent for the disclosure.
Other Disclosures
We may disclose non-personally identifiable aggregated information about our users without restriction.
Except as otherwise provided in this policy, we disclose the potentially personally-identifying information you disclose to TipStars only to those of our employees, contractors and affiliated organizations that (i) need to know that information in order to process it on our behalf or to provide the Services, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country and by using the Services, you consent to the transfer of such information to them.
Other than to its employees, contractors and affiliated organizations or as described above, we disclose personally-identifying only when required to do so by law, or when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of TipStars, third parties or the public at large. If you send us a request (for example via chat, a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.
In addition, in some cases we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if TipStars or substantially all of its assets were acquired, or in the unlikely event that TipStars goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of TipStars may continue to use your personal and non-personal information only as set forth in this policy. Social Security Number Policy
TipStars, LLC (“TipStars”, “we”, “us” or “our”) is committed to maintaining the confidentiality of Social Security numbers that we collect during the regular course of our business. Accordingly, TipStars has established this Social Security Number Privacy Protection Policy (the “Policy”) to restrict access, disclosure, use, and disposal of social security numbers that we have collected.
1. Collection and Use of Social Security Number
TipStars collects and uses your social security number for the sole purpose of reporting that is required by law for tax purposes.
2. Access Restrictions and Disclosures
TipStars restricts access to your social security number only to those of our employees, contractors and affiliated organizations that (i) need to know that information in order to process it on our behalf, and (ii) that have agreed not to disclose it to others. Documents, materials or computer screens that display social security numbers shall be shown only to authorized employees and third parties and shall be kept out of public view at all times. Social security numbers (in full or in part) are never used as publically displayed account or identification numbers.No social security numbers (in full or in part) will be used in open computer transmissions or company distributions or through the company intranet except where such transmission of information is by secure connection or is encrypted. As examples, reporting of payroll withholding taxes and benefits plan participation require such data; thus, such transmissions of data will be handled through secured computer transmission only.
3. Storage and Disposal
TipStars shall take reasonable steps so that all documents and files (both electronic and in hard copy) that contain social security numbers shall be stored in a physically secure manner. TipStars requires that social security numbers be stored in a way that prevents unauthorized access. For example, hard copy documents that social security numbers should be stored in files that can only be accessed by authorized employees or third parties, and computers or other electronic devices that contain social security numbers should be secured against unauthorized access, such as through the use of a password. TipStars requires that any authorized personnel who maintains social security numbers must take appropriate steps consistent with this Policy to safeguard such information.
Documents or other materials (both electronic and in hard copy) that contain social security numbers shall be disposed of in a manner such that the social security number is erased or made unreadable at the time of disposal. It may be necessary to consult with TipStars’s IT department to ensure proper disposal of social security numbers that are stored electronically.
4. Non-Compliance
Failure to comply with this Policy may result in disciplinary action up to and including termination. Furthermore, the law provides civil and criminal penalties for individuals who violate laws protecting the confidentiality of social security numbers.
